*941In an action, inter alia, for a judgment declaring that a certain life insurance policy is in full force and effect, the defendant appeals from an order of the Supreme Court, Rockland County (Kelly, J.), dated May 3, 2012, which granted the plaintiffs motion for summary judgment declaring that the life insurance policy is in full force and effect, and denied its cross motion for summary judgment, in effect, declaring that the policy is no longer in full force and effect.
