—Appeal from a judgment of Supreme Court, Erie County (Buscaglia, J.), entered May 20, 1999, convicting defendant after a jury trial of, inter alia, forgery in the second degree (three counts).

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously reversed on the law and a new trial is granted.
