Appeal by the defendant, the Union Railway Company of New York City, from a judgment of the' Supreme Court in favor of' the plaintiff, entered in the office of the clerk of the county of Kings on the 1st day of March, 1900, upon the verdict of a jury for $7,250, and also from an order entered in said clerk’s office on the 2d day of April, 1900, denying the defendant’s motion for a new trial made upon the minutes.

The plaintiff in this action- has been awarded a judgment for $7,658.91 as damages for the loss of services of his wife^ due to injuries received by the latter through the alleged negligence of the defendant and its servants in the operation of an electric power car on Third avenue in the borough of Manhattan. It is conceded on this appeal that there was sufficient evidence of the defendant’s negligence, and of the lack of contributory negligence on the part of plaintiff’s wife, to go to the jury, and the verdict is conceded to be conclusive upon these points, but it is urged…
