The appellee, I. H. Smith, sued the appellant, Mississippi Utilities Company, for a personal injury sustained by the appellee while employed by the appellant, alleging that, on the 21st of June, 1928, the appellant owned and operated an ice plant engaged in the manufacture of ice, and that the appellee was employed by the appellant and required to do such work as might be assigned to lira ly tie appellant’s manager, tie appellee’s superior officer.
