The appellant, plaintiff below, was injured in a collision between a motor scooter driven by him and an automobile driven by the defendant. Immediately prior to the accident, the plaintiff .was driving his motor scooter in an easterly direction on Esparanza Street in Ajo, Arizona. As the plaintiff reached the crest of a hill, defendant was approaching in the opposite direction along Esparanza Street.
