Appeal from an order of the Family Court of Tioga County (Squeglia, J.), entered July 3, 2007, which dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody and visitation.
Petitioner (hereinafter the father) and respondent (hereinafter the mother) are the parents of a child born in September 2003. In August 2006, based upon the parties’ stipulation, Family Court entered an order granting the mother sole custody of the child and the father the right to re file a petition without alleging a change in circumstances.
