In an action to recover damages for personal injuries, etc., the defendant appeals from an order of the Supreme Court, Westchester County (Jamieson, J.), dated March 26, 2013, which granted the plaintiffs’ motion for summary judgment on the cause of action alleging a violation of Labor Law § 240 (1) and denied the defendant’s cross motion for summary judgment dismissing the causes of action alleging a violation of Labor Law § 240 (1), and a violation of Labor Law § 241 (6) insofar as predicated on 12 NYCRR 23-1.7 (d) and (e) (2).
