Prank Holoubek, the plaintiff in the district court, a boy fourteen years of age, was employed by Swift & Co., *229a corporation operating a packing bonse in South Omaha, and while so employed his hand was caught in the machinery and three fingers were lost. He sued to recover for this injury and recovered a judgment for $5,000, which the defendant seeks by these proceedings to reverse.

The court gave the following instruction at the request of the plaintiff: “You are instructed that in determining whether plaintiff exercised ordinary care it is proper for you to take into consideration…
