Daniel R. Dillon brought his action against Anson Mohr t.o recover damages in. the sum of $500; it being alleged by the plaintiff in his declaration that he had caused to be put up at auction for sale a certain tract of land of which he was owner; at which sale the defendant was the highest bidder and was declared the purchaser, the land being krfocked down to him for a specified sum; and that, notwithstanding the plaintiff had been ready and willing to make good and sufficient titles to the land and deliver possession of the land to the defendant, upon his paying the…
