Plaintiff alleges that it was organized. as a town by Act No. 71, 1878, and since its organization bad exercised all tbe privileges of a municipal corporation, averred that defendant, Felicien Boudreaux, was engaged in erecting a sbed or building on a strip of land lying between Levee street of said town and Bayou Lafourebe, and wbicb it alleges constitutes one of the banks of that stream.
