This was an action for breach of promise of marriage.- One branch of the defense was, that the defendant was a minor at the time the original promise was made — a fact not disputed — • and was still a minor in April, 1890, when, as alleged by the plaintiff and found by the jury, the promise was renewed. This question of fact, namely, the age of the defendant in April, 1890, was submitted to the jury, and was decided adversely to the defendant.
