Appeal by defendant from a judgment of the Supreme Court, Queens County, rendered November 17, 1975, convicting him of attempted possession of a weapon in the third degree, upon his plea of guilty, and imposing sentence. The appeal also brings up for review a prior order of the same court dated October 9, 1975, which denied defendant’s motion to suppress certain physical evidence. Judgment and order reversed, on the law and the facts, motion to suppress granted, and indictment dismissed.
