Plaintiff Dornoch Ltd. brings this declaratory judgment action for and on behalf of the Underwriting members of Lloyd’s Syndicate 1209 (the “Underwriters”) against defendants PBM Holdings, Inc. and PBM Nutritionals LLC (collectively “PBM”), which were the Underwriters’ insureds under product contamination insurance policy No. B0799/EL024800b (“the Policy”). The Underwriters seek a declaration that PBM is not entitled to coverage under the Policy for a loss that occurred in early 2009, because PBM allegedly failed to meet a condition precedent to coverage…
