O’CONNOR, District Judge.

This is an action to enjoin defendant from making or publishing any statement, through and including November 7, 1978, which indicates or implies that defendant has the endorsement or support of the American Medical Association or the Kan sas Medical Society. The matter is presently before the court on plaintiffs’ motion for a preliminary injunction and defendant’s motion to dismiss for lack of jurisdiction and for failure to state a claim.
