MEMORANDUM AND ORDER GRANTING SUMMARY JUDGMENT TO THE UNITED STATES

THEIS, Senior District Judge.

This is an old case that has been moving falteringly toward a resolution on the merits for the last six years. In the course of these lengthy proceedings the United States has experienced a frequent turnover of legal personnel, with fourteen different at*708torneys representing it at various times.
