FOLLEY, Justice.

This is a suit between the Continental Assurance Company, plaintiff in error and defendant in the trial court, and C. A. Gib-ner, executor of the estate of L. L. Plughes, deceased, defendant in error and plaintiff in the trial court. L. L. Hughes acquired title to the land involved in this suit subsequent to the creation of a mortgage on said land in favor of the Continental Assurance Company by Edna F.
