In the case of White v. Inebriates' Home for Kings County (141 N. Y. 123) the question of the constitutionality of the provision in the act, chapter 169 of the Laws of 1877, requiring the comptroller of the city of Brooklyn to pay to the treasurer of the home fifteen pier cent of the excise moneys received from licenses granted by the excise commissioners of the city, vras presented and decided. The question arose under the Constitution in force prior to January 1,1895, and the constitutionality of the provision was assailed on the ground that it violated section 11 of art. 8…
