BATEMAN, Justice.

The appellant Señora Gant sued the ap-pellees St. Louis-San Francisco Railway Company and Robert C. Yowell in her own behalf and as next friend for her minor son Paul Kevin Schultz, herein called Kevin, claiming damages for injuries sustained by him. Kevin was 8 years of age and his brother Edwin Keith Schultz was two years older when, pursuant to their plan to run away from their home, they were attempting to board a moving freight train of appellee Railway Company, on which appellee Yowell was the engineer.
