The State Bar filed a Formal Complaint against Respondent M. Randall Peek alleging violations of Standards 65 (D) (withdrawal of funds from an attorney trust account for personal use) and 65 (A) (failure to account for trust property held in a fiduciary capacity) of Bar Rule 4-102 (d). Upon Peek’s failure to file a timely answer to the Formal Complaint after the State Bar perfected service by publication pursuant to Bar Rule 4-203.1 (a) and (b) (3) (ii), Peek was in default and subject to the discipline of this Court.
