OPINION ON MOTION FOR REHEARING
TIM TAFT, Justice.
On September 9, 1999, we reversed the trial court’s summary judgment in favor of appellee, Anna Marie Madison. Madison has filed a motion for rehearing. We deny the motion for rehearing, but we withdraw our prior opinion, and issue this opinion in its stead.
Appellant, Ronald X. Gordon, sued Madison and others for damages and to reclaim title to real property formerly owned as his homestead. Gordon appeals from summary judgments in favor of Madison and against Gordon. We address whether Madison’s failure to inspect the property to determine the…
