The plaintiff brought an action for medical expenses incurred by him and for loss of consortium result*234ing from an alleged injury to his wife said to have been caused by a dog owned and kept by the defendant. Defendant seasonably filed a motion to dismiss the complaint on the ground that it failed to state a claim upon which relief can be granted. This motion was granted below and the plaintiff appeals.

The complaint seeks to enforce the remedy provided by R. S., Chap. 100, Sec. 17 as amended by P. L., 1961, Chap. 317, Sec. 303 which provides
