BROWN, Justice.

The appellant was tried on an indictment returned by a grand jury impaneled in the Circuit Court of Montgomery County, charging him with murder in the first degree, substantially in the form prescribed by the statute. Code of 1940, Title 15, § 259, Form 79, p. 429. The person alleged to have been killed was William Patterson and the means by which the offense was committed, as alleged in the indictment, was “by cutting him with a knife” and was sufficient compliance with' the statute.
