Appeal from the District Court of Fannin. Tried below before Hon. Ben H. Denton. Appeal from a conviction of murder in the first degree; penalty, imprisonment in the penitentiary for life. The indictment charged appellant with the murder of I. J. Martin (his son-in-law), on the first day of May, 1901, by shooting him with a pistol.

BROOKS, Judge.
Appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life.
The following are substantially the facts adduced upon the trial: Deceased and his wife, Hannie Martin, and four children, lived on a farm south of Honey Grove, in Fannin County.
