MEMORANDUM AND ORDER
SAFFELS, District Judge.
This matter is before the court on the motion of defendant United States of America (“defendant”) to dismiss, or in the alternative, for summary judgment.
This is an action alleging invasion of privacy against the United States of America, pursuant to the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b) and 2671, et seq. The relevant contentions and allegations of facts as stated in plaintiffs second amended complaint may be briefly summarized as follows. Plaintiff Rosamarica B.
