Appeal from an amended order of the Supreme Court, Erie *1054County (Joseph R. Glownia, J.), entered December 16, 2003. The amended order granted plaintiffs motion for partial summary judgment on liability on the Labor Law § 240 (1) claim and denied defendants’ cross motion for partial summary judgment dismissing the Labor Law § 200 claim.
It is hereby ordered that the amended order so appealed from be and the same hereby is unanimously affirmed with costs.
