Our opinion and judgment issued on December 8, 2010, are withdrawn, and the following opinion is substituted.
Appellees Lou Ann Smith, Jimmy Jackson Smith, individually and as next friend of Rachel and Grayson Smith, and Karen E. Gravely (collectively, the “Smiths”) sued appellants Black -l- Vernooy Architects, J. Sinclair Black, and D.
