ERICKSTAD, Chief Justice.

The defendant appeals from a judgment of conviction entered on March 27, 1979 in the Morton County District Court. We affirm.

The defendant, William J. Berger, was convicted on two counts of a violation of Section 19-08.1-23, N.D.C.C., one count referring to delivery of a controlled substance (marijuana) and the other possession of a controlled substance with the intent to deliver (marijuana).
