The dominant question involved in this litigation is, who is entitled to the custody of Phillip Mears Collins (an infant, five years of age and "the son of appellant and appellee)?

Denny Collins, appellee, and Madeline Mears, appellant, were married on September 18, 1933, in Pocomoke City, Maryland. Their son Phillip was born of this marriage on *410August 8, 1939. Domestic discord, as shown by the record, seemed to be the dominant note in their marital relations.

On September 12, 1942, suit was instituted by appellee against appellant, on the ground of desertion. To the bill of complaint appellant…
