Appeal from the Superior Court of Baltimore City. Action brought on the 10th of September 1857, by the appellant against the appellee, to recover damages for delivering up to one Kingsmore certain title papers, in violation of a contract by which the defendant had agreed to hold said papers, as security for the payment, to the plaintiff, of the sum of $500, as commissions for services rendered by the plaintiff to said Kingsmore.

In the opinion of this court, the motion to dismiss this appeal ought not to prevail. The question has been settled by the case of The State, use of Hickley, vs. Stewart & Gross, 12 G. & J., 456, where an appeal from the judgment of the county court setting aside an award, was sustained. ¡
We think the court below erred in sustaining the objec*312lions to the award and setting it aside. It is shown by the return to the writ of diminution, that the reference in this case was made under a rule of court.
