This is an action to recover damages for the death of plaintiff’s intestate and son, Michael, caused by being struck by the defendant’s moving car, about 4 o’clock in the afternoon of May 16,1898. Issue being joined and trial had, the jury returned a special yerdict to the effect (1) that the boy killed by the accident was not of sufficient age, capacity, and experience to understand the danger and risk of going upon the railway track without looking and listening, at the time, place, and under the circumstances, to the same extent as an ordinary adult person; (2) that the boy…
