KILKENNY, District Judge:
This cause is here for review of a decision by the Secretary of Interior, in which he denied the plaintiff a selection *391of 160 acres of public land in Lincoln County, Oregon, in exchange for certain scrip. This scrip was issued by the United States Government and authorized the selection of tracts of land from the public domain. Plaintiff holds a Valentine Special Certificate for 40. acres,1 a Gerard Special Certificate for 80 acres,2 and a Porterfield Warrant for 40 acres.3 The authenticity and validity of the scrip is admitted by defendant.
