ORDER
EDENFIELD, District Judge.
This action, based upon the Securities Exchange Act of 1934, is currently before the court on defendant’s motion for judgment on the pleadings and its motion to dismiss for failure to state a claim on which relief can be granted.
During the years 1971-1973, plaintiff maintained an account with the defendant for the purpose of investing funds in securities.
