This is a suit in equity to vacate an assessment on plaintiff’s lands in the city of Lockport, levied to defray part of the expenses of a local improvement.

The improvement was the grading, curbing and paving of West avenue, East Main street and East avenue, which form one continuous street from Transit street on the west, through the principal business and residence part of the city to the easterly city line, a total distance of nearly one and a half miles.
