Where, in a petition to the Superior Court of Fulton County for certiorari, based solely on the general grounds, it appears that the petitioner had been convicted in the Criminal Court of Fulton County of the offense of keeping, maintaining, and operating a lottery, known as the number game, and it appears from the brief of evidence, attached to and made a part of the petition for certiorari, that the petitioner was arrested on July 11, 1951, on Howell Street in the City of Atlanta by officers who testified that there was a lottery in operation in the city on the day of the arrest and…
