Holloway was convicted of tbe crime of robbery with firearms, tbe jury fixing tbe death penalty.

He first contends that tbe proof is insufficient to identify bim as tbe robber. Tbe person robbed was Mr. J. B. Leavell, and tbe place was inside bis store in Marshall County, Mississippi. Blaine Yarbrough, wbo lived two miles from tbe store, testified that be was at tbe store a little after sundown of tbe day of tbe robbery; and appellant and two other persons appeared at tbe store; that appellant inquired of him tbe name of tbe owner of tbe store and…
