JUSTICE, Chief Judge.
I. PROCEDURAL HISTORY.
This civil action was instituted by the United States on March 6, 1970. The complaint charged that the defendant State of Texas and its agents, including the Texas Education Agency (hereinafter referred to as “TEA”), had created and maintained nine all-Black school districts throughout the state and had failed to provide equal educational opportunity without regard to race.
