DeBRULER, Justice.

This case comes before the Court on petition to transfer. Appellant Ray Howard (Howard) brought suit against Appellee Incorporated Town of North Judson (North Judson) for wrongful termination. The trial court found that Howard had not availed himself of the statutorily available hearing and granted North Judson’s motion to dismiss for lack of subject matter jurisdiction.
