MEMORANDUM OPINION AND ORDER

PIERSOL, District Judge.

Plaintiff William Meyers [“Meyers”] filed his original Complaint against Defendant American States Insurance in South Dakota State court, alleging claims for indemnification pursuant to S.D.C.L. § 60-2^1, wrongful termination, and intentional infliction of emotional distress.
