ALLEN, Circuit Judge.
This is an appeal from a judgment for $3,250 rendered upon a jury verdict in a personal injury suit. Appellant complains of the charge of the court, and of the denial of a motion for a directed verdict.
Appellant owns and operates a saw mill in Tipton County, Tennessee. Appellee was a workman at the mill, and upon the night of March 24, 1932, together with another of appellant’s employees, was sleeping at appellant’s house. Appellant was notified at eleven P.
