Riley, Judge:

Moore M. Reynolds, Sheriff of Harrison County, West Virginia, for the use and benefit and at the relation of Olice Jenkins, brought this action in debt in the Circuit Court of Harrison County against Arthur J. Griffith and The Fidelity & Casualty Company of New York, upon the official bond in the sum of five thousand dollars of Griffith, a deputy sheriff of said county, charging that he “did not faithfully perform the condition of said bond”.
