The action is in trespass to realty, stated in numerous counts, to which demurrers were sustained, necessitating a nonsuit by plaintiff, and an appeal to review the rulings thereon.
There are but two major questions presented, so discussed by counsel in brief, and no necessity arises for a separate treatment of the several counts of the complaint. The pleadings disclose (with particular reference to counts 9 and 10) that plaintiff is one of the heirs of James F.
