Appellant was found guilty by the court without a jury of operating a motor vehicle while under the influence of intoxicating liquor and sentenced to the Indiana State Farm for 60 days and to pay a fine of $10. He, has appealed, assigning that the trial court erred in denying his motion for a new trial, in which he asserted that the finding was not sustained by sufficient evidence and that it was contrary to law.
