The indictment charges the defendant with the theft of a horse, the property of Columbus C. Littlefield. The jury found the defendant guilty as charged in *724the indictment, and assessed his punishment at five years confinement in the penitentiary, and after the return of the verdict the court adjudged the defendant guilty of theft of a horse, as found by the jury.
