Appeal from court of general sessions, New York county. Eugene A. Pinckney was convicted of grand larceny in the second degree, and he appeals.

The defendant was indicted, charged with the crime of grand larceny in the second degree. It appears that on the 14th of May, 1892, the defendant called at the store of one Denholme, who, with his partner, carried on the business of dealing in shirts and men’s furnishing goods, and purchased some goods, of the value of $12.45, and requested that a check which he then presented, for $96.75, be cashed, the amount of the purchase which he then made to be taken out; also the sum of $4.50, the amount of a purchase made by him a few days previously.
