(dissenting, with whom Spina, J., joins). I respect*276fully dissent based on my conclusion that the juvenile has no “constitutionally protected reasonable expectation of privacy.” Commonwealth v. Montanez, 410 Mass. 290, 301 (1991). I agree with the well-reasoned analysis of the Appeals Court in this regard. See Commonwealth v. Porter P., 73 Mass. App. Ct. 85, 91-94 (2008). It follows that the director of the Roxbury Multi-Service Center, Inc., Family House Shelter (shelter) acted well within her rights in admitting police to the juvenile’s room, and suppression of the firearm and the juvenile’s…
