LATTIMORE, Judge.

Appellant was convicted in the District Court of Tom Green County of felony theft, and his punishment fixed at two years in the penitentiary.

The property stolen was a jersey heifer. The alleged owner testified that after searching for his animal he found where she had been killed near an old well not far from an abandoned house in the little village of Knickerbocker in Tom Green County.
