This suit was instituted in the District Court of Starr County, Texas, by Daniel Garcia and some one hundred and twenty-nine other persons, against Jose S. Hino-josa, individually and as County Cleyk of Starr County, seeking to compel him to permit plaintiffs to cast their absentee ballots in the general election to be held on 'November 4, 1952.
A hearing was had on October 25, 1952, and judgment rendered requiring defendant to permit plaintiffs to cast their absentee votes, in the following language, to-wit:
