The firs error assigned by appellant in this case is that the court be low refused to instruct the jury, as requested by appellant that the plaintiff had failed to show that he received th< injuries alleged in the complaint through the negligence o carelessness of the defendant, its agents, servants, or em ployes, and therefore that the jury should return a verdic for the defendant.
