On December 5, 1881, Phoebe Tyler brought an action of ejectment against John E. Putnam to recover a lot of ground containing about one third of an acre, with a dwelling house and other improvements thereon. A like suit was brought by the same plaintiff against Charles W. Scates, for another lot of like size, and with like improvements.

The first question presented in this case is, as to the effect of the outstanding tax title in Jones, Warner & Andrews. *583Why was not that title a valid defence against the plaintiff’s recovery ?
