FREEMAN, District Judge.
After háving exhausted all State administrative remedies, plaintiff filed this declaratory judgment action under 28 U.S.C.A. § 2201 to declare the assessments for 1960 and 1961 ad valorem taxes on certain industrial real estate in the City of Detroit owned by plaintiff, as being in violation of the due process and equal protection clauses of the Fourteenth Amendment, and asks that such assessments be fixed by the Court in the amount paid by plaintiff for the property in 1960.
